By downloading, accessing, or using Mermaid – Wind, Surf & Tides ("Mermaid"), you agree to these Terms of Service. If you do not agree, do not use Mermaid.

If you downloaded Mermaid through Apple’s App Store, your use is also subject to Apple’s applicable terms, including Apple’s Standard End User License Agreement unless a different agreement is shown in App Store Connect.

Mermaid provides maps, forecasts, tide predictions, observed buoy data, beach-shelter recommendations, fishing outlooks, ferry camera images, and links to third-party information. Features and geographic coverage may change over time.

Mermaid is for general information and trip planning only. It is not a substitute for official marine forecasts, navigation charts, notices to mariners, emergency alerts, local knowledge, or direct observation of current conditions.

Forecasts, tide times, wave conditions, ferry information, and recommendations may be delayed, incomplete, inaccurate, or unavailable. Conditions can change quickly. Always check official sources and use appropriate judgement, equipment, and qualified advice before boating, swimming, surfing, fishing, travelling, or entering coastal areas.

Do not use Mermaid as your only source for decisions involving personal safety, vessel safety, property, legal compliance, or emergency response. In an emergency, contact the appropriate local emergency service.

Fishing scores and suggested windows estimate environmental favourability; they do not guarantee a catch. They may not reflect your fishing method, vessel, species, exact location, experience, or rapidly changing local conditions.

You are responsible for checking current licences, closures, conservation measures, species identification, catch limits, gear rules, and all other applicable fishing regulations before fishing.

Mermaid depends on public and third-party data services. Those providers retain ownership of their content and may impose separate terms or attribution requirements. References to a provider do not imply endorsement by that provider.

Third-party websites, cameras, APIs, and datasets are outside our control. We are not responsible for their availability, accuracy, security, content, or privacy practices.

Subject to these terms, you may use Mermaid for personal, lawful purposes. You may not interfere with the service, bypass access controls, misuse data providers, introduce malicious code, falsely imply affiliation, or use Mermaid in a way that violates law or the rights of others.

Mermaid’s original software, design, branding, and content are protected by applicable intellectual-property laws. Third-party maps, imagery, forecasts, observations, camera images, and data remain subject to their respective owners’ rights.

If you provide suggestions or feedback, you allow us to use them to improve Mermaid without obligation or compensation, while you retain ownership of any rights you already hold.

We may add, change, suspend, or discontinue features, locations, data sources, or access to Mermaid. We do not promise that the service will always be available, error-free, or compatible with every device.

To the maximum extent permitted by law, Mermaid is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, and availability.

Nothing in these terms excludes a warranty or consumer right that cannot legally be excluded.

To the maximum extent permitted by law, Mermaid’s developer and contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, use, goodwill, or other intangible losses arising from use of or inability to use Mermaid or reliance on its information.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.

These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Any mandatory consumer protections available where you live continue to apply.

We may update these terms as Mermaid changes. Continuing to use Mermaid after updated terms take effect means you accept the revised terms, to the extent permitted by law.
